Advertiser terms
Draft for legal review. These terms apply to every agency, agent and private advertiser who advertises on ADDRESS263.
1. Who may advertise
You must be the owner of the property, or hold a written mandate from the owner, and you must give accurate identity and contact details. Estate agency activity in Zimbabwe is regulated; you are responsible for holding any registration your activity requires.
2. Your listings
Listings must comply with our acceptable listings policy: real, available property, accurate prices in the stated currency, genuine photographs of that property, correct location and no duplicate entries for the same property. You must reconfirm availability every 30 days; unconfirmed listings expire automatically.
3. Payment and renewal
Packages and subscriptions are priced in US dollars and payable in advance. Listings go live only after payment is confirmed and moderation is passed. Subscriptions renew each period until cancelled, and you may cancel with effect from the end of the current paid period. Where a payment fails, we allow a grace period before advertising is paused.
4. Refunds
Refunds are governed by our refund and cancellation policy. In summary: we refund duplicate or failed payments in full, and we do not refund unused time where advertising was delivered.
5. Content licence
You keep ownership of your photographs and descriptions and grant us a non-exclusive, royalty-free licence to host, resize, display and promote them on the platform and in our own marketing while the listing is live and for a reasonable period afterwards. You confirm you hold the rights to everything you upload.
6. Moderation and removal
We may decline, request changes to, pause or remove any listing, and suspend any account, where we reasonably believe these terms have been breached, a report is high risk, or the listing may mislead. High-risk reports pause a listing immediately pending review. Every decision is recorded in an audit log.
7. Our role
We provide advertising only. We do not act as estate agent, valuer, lawyer or escrow provider, we do not verify ownership or title, we do not hold funds, and we do not guarantee a number of enquiries, viewings or sales.
8. Liability
You are responsible for your listings and for your dealings with enquirers, and you indemnify us against claims arising from them. Our liability to you is limited to the fees you paid us in the three months before the claim, to the extent permitted by law.
These terms require Zimbabwean legal review covering estate agency advertising, consumer protection, tax and data protection obligations before launch.
